Terms and Conditions for Holiday Rental - Villa Silene – Barat, Istria, Croatia

1. General

These Terms and Conditions govern the rental of the holiday house located in Istria, Croatia, known as Villa Silene, Barat (hereinafter the “Property”), between the property owner or manager (the “Owner”) and the person making the reservation (the “Guest”).

By making a reservation, the Guest confirms that they have read, understood, and accepted these Terms and Conditions.

2. Reservation and Booking Confirmation

A reservation request does not constitute a binding booking.

The booking becomes final and binding only after the Owner has received the required 10% deposit payment of the total rental amount.

Until the deposit has been received, the requested dates remain open and may be booked by other guests without prior notice.

3. Payments

3.1 Deposit

A deposit of 10% of the total rental price is due at the time of reservation.

3.2 Final Payment

The remaining 90% balance must be paid no later than 2 months prior to the scheduled arrival date.

If the final payment is not received by the due date, the Owner reserves the right to cancel the booking and retain the deposit, unless otherwise agreed in writing.

4. Cancellation Policy

All cancellations must be made in writing.

4.1 Cancellation up to 2 Months Before Arrival

If the Guest cancels more than 2 months before the arrival date, a full refund of all payments made, excluding the deposit, will be granted.

4.2 Cancellation Between 2 Months and 1 Months Before Arrival

If the Guest cancels between 2 months and 1 months before arrival, 50% of the total rental amount will be refunded.

4.3 Cancellation Within 1 Months Before Arrival

If the Guest cancels within 1 months of the arrival date, no refund will be possible.

5. Use of the Property

The Property may only be used for holiday accommodation purposes and solely by the number of persons agreed in the reservation.

The Guest agrees to treat the Property with care and to leave it in a clean and orderly condition upon departure.

House Rules:

The Property is a strictly non-smoking house. Smoking is not permitted anywhere inside.

Pets are not allowed on the Property.

Groups consisting solely of persons under the age of 25 are not permitted.
The Owner reserves the right to refuse check-in if this condition is not met.

Parties, events, and excessive noise are strictly prohibited.

Violation of house rules may result in immediate termination of the stay without refund.

6. Check-in and Check-out

Check-in: from 16:00

Check-out: by 10:00

Different times are only possible upon prior agreement and subject to availability.

7. Liability and Damages

The Guest is responsible for any damage to the Property or its contents caused during the stay.

The Owner reserves the right to charge the Guest for damages, excessive cleaning, or missing items.

The Owner shall not be liable for:

loss, theft, or damage to the Guest’s personal belongings;

accidents, injuries, or damages occurring during the stay, except where caused by gross negligence or intentional misconduct by the Owner;

temporary failure or interruption of utilities or services beyond the Owner’s control.

8. Force Majeure

The Owner shall not be held liable for cancellation, delay, or interruption of the stay due to circumstances beyond reasonable control, including but not limited to natural disasters, government restrictions, war, strikes, pandemics, or other force majeure events.

9. Applicable Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with Croatian law.
Any disputes shall be subject to the jurisdiction of the competent courts in Croatia.

10. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain fully valid and enforceable.

11. Acceptance

By making a reservation and paying the deposit, the Guest confirms acceptance of these Terms and Conditions in full.
